Terms of Service

By creating an account or using TerraGrid (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and TerraGrid (“we”, “us”, or “our”).

We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the Service. Continued use after changes constitutes acceptance.

TerraGrid is a web-based land design and planning tool that allows users to draw shapes, measure areas and distances, organise layers, attach cost estimates, and export maps as PDFs — directly on satellite imagery. The Service is accessed through a web browser; no software installation is required.

Features and availability may vary by subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep it updated.

You are responsible for maintaining the security of your account credentials. You must notify us immediately at legal@terragrid.com if you suspect unauthorised access to your account. We are not liable for losses arising from unauthorised use of your account.

Accounts are personal. You may not share your account credentials with others, except within the organisation and multi-user features provided by the Service.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights of any party.
• Transmit malicious code, spam, or disruptive content.
• Attempt to gain unauthorised access to any system or account.
• Reverse-engineer or attempt to extract source code from the Service.
• Resell or sublicense access to the Service without our written consent.
• Use the Service in any way that could damage, disable, or impair it.

We reserve the right to suspend or terminate your account immediately if we reasonably believe you have violated these rules.

TerraGrid offers a free plan and paid subscription plans. Paid plans are billed monthly in South African Rand (ZAR). Prices are displayed on our pricing page and may be subject to applicable taxes.

Subscriptions renew automatically at the end of each billing period. You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. We do not prorate partial months.

We reserve the right to change subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance.

All payments are processed securely by PayFast. We do not store your payment card details.

The Service, including its software, design, text, graphics, and other content, is owned by TerraGrid and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our express written permission.

You retain ownership of all map data, shapes, labels, and other content you create within the Service (“User Content”). By using the Service, you grant us a limited licence to store and process your User Content solely to provide the Service to you.

You represent that you have the necessary rights to any User Content you submit, and that it does not infringe any third-party rights.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Area and distance measurements provided by the Service are calculated geodetically and are intended as planning estimates only. They should not be used as a substitute for a professional survey for legal, regulatory, or construction purposes.

We are not responsible for the accuracy, completeness, or availability of satellite imagery or map data provided by our third-party mapping provider.

To the maximum extent permitted by applicable law, TerraGrid and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
